The following is a transcription of a document found amongst the deeds for 17 Burn Rd, Birchencliffe, Huddersfield. There is no mention of this property in the document which deals with the loan of £30 to Matilda NUTTON. As one of the owners of the above property was called NUTTON I think the document may have been misfiled at some time. If anyone can suggest any other reason why it should have been included with the deeds I would love to hear from them.
This indenture made the sixteenth day of October One thousand nine hundred and twelve BETWEEN MATILDA NUTTON the wife of Walter NUTTON of 18 South Lane, Elland in the County of York Erector of the one part and ISAAC YOUNG of Tennyson Bungalow, Lightclife in the said County....... Gentleman of the other part
whereas Elizabeth GLEDHILL therein.....described as of number 61 Seymour Street Leeds Road Bradford in the said County Widow duly made her last will and Testament dated the twentyeighth day of February one thousand eight hundred and eighty four whereby she gave devised and bequeathed the whole of her money real and personal estate whatsoever to her executors and trustees thereinafter named Upon trust to be disposed of in manner therein following that is to say Testatrix after directing payment of her just and lawful debts and funeral and testamentary expenses and after making a certain specific bequest therein named directed that her executors with all convenient speed after her decease should sell or cause to be sold for the best price or prices which could be obtained either by public auction or private contract as her executors might think best at the time all her real and personal estate whatsoever
And Testatrix directed that her trustees should invest the proceeds of sale in manner therein mentioned and should pay the annual income and interest thereof and the interest of her residuary estate whatsoever to her brother Alfred RAMSDEN or allow him to receive the same quarterly as the same became due during the whole of his natural life and Testatrix provided that if her trustees did not hear from her brother they should pay the whole of the said interest and income into the Bradford and East Morley Savings Bank quarterly until he should claim the same but if no claim should be made by him before the expiration of Fifteen years after her death then she directed that his share be disposed of as if he were dead And at the death of her brother or if no claim by him within fifteen years of her death Testatrix directed that her Trustees should pay the net income of her estate to Richard CLARK the son of her sister Matilda CLARK and to her three grandchildren namely Eliza WATERHOUSE Mary Ann ACKROYD and the said Matilda NUTTON (therein described as Matilda ACKROYD) each one to have an equal share of one fourth part to be paid to them half yearly during the whole of their natural lives
(There is now a long and detailed description of the how the money should be dealt with in the case of any of the children or grandchildren dying.)
And Testatrix nominated and appointed Henry HOLLAND and John CAMPBELL to be the executors of her now being recited will and whereas the said testatrix died on the fourteenth day of March one thousand eight hundred and eighty five duly proved in the district registry at Wakefield of the Probate Division of the High Court of Justice by both the executors therein named
And whereas the said Alfred RAMSDEN died on the day of one thousand eight hundred and eighty eight AND whereas since the lastly mentioned date the said Matilda NUTTON has enjoyed a fourth part or share of the income of the residuary estate of the said Elizabeth GLEDHILL deceased pursuant to the trusts of the said will and whereas the said Henry HOLLAND died on the twentyfirst day of June one thousand eight hundred and ninety nine
and whereas by Indenture dated the twentyeighth day of September one thousand nine hundred and eight and made between the said John CAMPBELL of the one part and Henry HOWE and Charles Henry HITCHEN of the other part said John CAMPBELL thereby appointed the said Henry HOWE and Charles Henry HITCHEN to be the Trustees of the said will of the said Elizabeth GLEDHILL deceased jointly with himself and the said Henry HOWE and Charles Henry HITCHEN did thereby consent to be such Trustees
And whereas the said John CAMPBELL died on the ninth day of April one thousand nine hundred and nine
And whereas the said Matilda NUTTON has requested the said Isaac YOUNG to lend her the sum of thirty pounds which he has agreed to do.
The remainder of the document details the security for the loan, part of which is the interest willed to her by Elizabeth GLEDHILL along with two insurance policies, and the method by which the loan is to be repaid. There is no mention of what the loan is for.
The document is signed by Matilda NUTTON and witnessed by Riley LAMBERT, Clerk with Howe & Gregory Solicitors, Bradford.
